  • If someone passes away with a valid Will, the Executor may need to apply for Probate. This is a formal Court process that confirms the Will is legally valid and gives the Executor authority to manage the Estate. This includes paying debts, closing accounts and distributing assets to beneficiaries.

    • Reviewing the Will and advising the Executor/s on their duties;

    • Preparing and lodging the Probate application with the Supreme Court of Queensland;

    • Managing timelines and Court requirements; and

    • Supporting Executors through the estate administration process.

  • If a person passes away without a Will, the next of kin (often a spouse or child) may need to apply for Letters of Administration. This gives them the legal authority to deal with the estate in accordance with Queensland’s intestacy laws. We assist with:

    • Identifying the appropriate person to apply;

    • Preparing and lodging the Letters of Administration application;

    • Explaining how the Estate must be distributed under the law; and

    • Supporting you through the entire process.
